QUEBEC BILL 430


Since January 1 st 2006 , only owners and/or operators of a heavy vehicle registered in Quebec and the United States are req uired to register with the Commission of Transport.  Other carriers must register with their respective administrations and their attestation of registration is sufficient to allow them to put a vehicle into operation in Quebec , provided that this attestation remains valid.

Definition of Owner and Operator:

Owner : Person who owns a heavy vehicle registered in Quebec under his/her name as owner or as a long term lessee or has acquired such a vehicle through a lease contract.

Operator :  Person who offers transportation services for persons or goods, offer vehicle assistance, operate a heavy vehicle for their own purposes and operate a heavy vehicle as equipment.  The operator may own a heavy vehicle or have it at his disposal through a lease contract, regardless of whether the lessor provides the services of a driver.

Who needs to register ?

-Private or Public carriers.

-A Road vehicle or a combination of road vehicles with a net mass in excess of 3,000kg (6,612lbs) and more.

-A tow truck, minibus, bus, road vehicle hauling dangerous substances req uiring placards regardless of their weight.

-Combination of vehicles composed of a pick up truck of 2,500kg and a trailer of 900kg with an overall length of more than 10m (10.1) including the hitch.

Exemptions:

-Combination of vehicles with a net mass over 3,000kg but each vehicles weighs less than 3,000kg

-Farm tractors, farm machinery and farm trailers (owned by a farmer)

-An individual renting a truck for less than 15 days to transport people or goods for purpose other than commercial or professional

-An individual owning or renting a camper, motor home or trailer, when not used for commercial nor professional purposes

-Tool vehicles (special mobile equipment) with the following three characteristics:

            -they are not mounted on a truck chassis

            -they are designed to perform work

            -their work station is an integral part of the cab (grader, etc…)

-An individual who uses a heavy vehicle for personal purposes other than commercial or professional

- US brokers working for a transportation company do not need to register since the company needs to

Private or public carriers have to be registered if they drop and/or pick up in Quebec and it doesn't matter where they are from ( Canada or USA )

Someone doing business under his own name doesn't have to register:

Example: Bob Walsh dba Bob Walsh Trucking

Sole proprietor:  Example:  Bob Walsh dba Walsh Trucking ($32.00)

Partnership:  Example:  Bob Walsh & Mary Hudson ($43.00)

Corporation:  Example:  Bob Walsh Trucking Inc. ($212 or $332.80)

Need resident agent when they have to register with Corporate Registry ($100.00)
